On 7 June 2023, the Pay Transparency Directive (2023/970/EU, EUPTD) entered into force. The EUPTD will bring about acomprehensive revision of the German Pay Transparency Act (Entgelttransparenzgesetz).
The national implementation of the EUPTD into German law is still pending, with a first draft of the domestic implementing act expected in the fourth quarter of 2025. Many employers headquartered (or having their registered office) in Germany are already intensively addressing the emerging requirements. In addition to the establishment and/or continuation of existing remuneration structures and pay gap analyses, numerous companies have also carried out analyses regarding (potential) addressees of individual employees’ pay transparency rights under Articles 5 et seq. EUPTD as well as reporting obligations pursuant to Article 9 EUPTD. This is particularly noticeable among international corporate groups with subsidiaries and/or branches in EEA and non-EEA countries.
